Mandatory Licenses required to start a school in India

Introduction
If you are planning to start a school in India, what you need to understand first is that in each step of opening the school you require some extent of license, certificate or documentation which you need to create and maintain for future use. Getting License is one of the pivotal jobs you will do when you are opening a school.
A broad list of the license required to start your school is described as below;-
1. Certificate of Registration for society
Schools in India are operated by nonprofit entities like trust and societies. Hence, if you are planning to open a school, then you will have to apply for society or trust registration in India. Trust registration can be obtained by visiting the local SDM office. Public Trust registration has no specific act and hence governed by registration act.
The other option is to register a society in India by visiting the registrar of societies. One of the prime options now a day to register a school is to register a section 8 Company. Section 8 is the corporate version of non profit organisation in India. Hence, it is recommended to start the section 8 company in order to start a school in India.
2. Essentiality of Certificate
The essentiality of Certificate is issued by the Directorate of Education. An EC is an essential document certifying the requirement of a school in a particular zone. DoE checks the area and sees if there is any demand for a school in that particular zone and accordingly finalizes the license.
3. Certificate of Recognition
A certificate of Recognition is issued by the respective municipal corporation of your area. It is a certificate issued to get the school recognized in that particular state or area. It states the existence, legality or validity of the school in that particular area.
4. Certificate of Upgradation
A Certificate of Upgradation is issued by the Directorate of Education for upgrading the school from primary to secondary or from secondary to a higher level. The certificate of upgradation is available online, however; it needs to be filed within the area of your jurisdiction along with the other supporting documents.
For example- Mr. K has opened a pre-nursery school in Delhi. After that, he wants to upgrade his school from pre-nursery to primary school. Now, Mr. K needs a certificate of Upgradation from DoE.
5.Certificate of affiliation
A certificate of affiliation is issued by the Central Board of Secondary Education. CBSE grants affiliation to various schools like government schools, private, unaided etc. It is essential to get your school affiliated from CBSE as it is a landmark in quality education.
CBSE provides three kinds of affiliation i.e. provisional, permanent and temporary affiliation for the following reasons –
- For approval of middle-class syllabus or adding a new subject in case your school is already affiliated.
- For upgrading the school to senior or secondary school
- For extension of Provisional Affiliation up to Secondary level.
6. Site plan for the school building
An affidavit is submitted to MCD/DDA stating the detail of site plan of the school building and regarding the purchase of land with condition that there is no violation of master plan for the use of land.
7. Building fitness certificate
It is mandatory for all school to have a building fitness certificate according to the government norms. The certificate is issued by the MCD. The building fitness certificate consists of the provisions that the school building is properly constructed, each classroom has proper space and ventilation or proper safety equipment has been installed including fire safety etc.
8. Health Certificate
A health certificate is issued by MCD to check the safety and hygiene level of the school. Proper sanitation, food provided in the canteen is healthy and clean.
9. Water Testing Report
Water testing report tests the quality of water which is going to be consumed by the children in the school. The report is issued by the Delhi Jal Board which testify the quality of water.
10. Scheme of Management
A scheme of management is formed and duly certified by the Department of Education. The scheme provides the detail of membership of the Board of Governors and set out the procedure and the guidelines for the managing the school and the functions to be exercised by the Board of Governor and Principal.
11. No Loan certificate
A certificate i.e. No loan Certificate is issued by the Bank stating that school has taken no loan against the Fixed Deposit.
12. Land permission
In case of rented land, a certificate which is duly signed by the landlord is to be issued to the school stating that the land is permitted to use for the purpose of the school and for no other purpose.
