No new LLP registration till 31st March 2018: Government suspends process
by Paras Mehra 9.17K
Do you know no new LLP registration can take place in India till 31st March 2018 due to non availability of the respective forms? This can happen only in India. With the world has progressed itself from a complete digital economy and companies registration takes only few hours, India still even lacks basic infrastructure to even support the LLP registration.
In simple words, LLP registration has been halted due to up gradation of existing forms and hence, if you want to start a new LLP, then you will not be able to get it till 31st March 2018. Let us understand the complete reason as to why LLP registration process has been affected due to unwanted government decision.
Why LLP Registration is not taking place?
To register a LLP in India, the person needs to apply for a DPIN (Designated Partner identification Number) number to start the process. Application for DPIN is the first step to start the LLP registration process. The DPIN is applied via DIR 3 form. Once DPIN is allotted, the name application is filled with ROC and thereafter final incorporation is filed.
To ease the process of LLP registration, the government proceeds on to merge the DPIN registration form with final registration, so that DPIN should not be applied separately. So government withdraws the form DIR 3 (for new DPIN application) without updating the existing LLP incorporation forms.
As a result, new DPIN cannot be applied and hence, LLP registration cannot take place in India until 31st March 2018.
Government Notification on MCA Portal
The government has notified all the stakeholders that LLP cannot be formed due to form up gradation and hence asked to plan properly. The notification is reproduced below:
“To facilitate corresponding changes in LLP eforms due to deprecation of DIR-3, it is proposed to temporarily suspend issuance of allotment of new DINs for Designated Partners/Partners of LLPs w.e.f 26th January 2018 till 31st March 2018. Stakeholders may kindly take note and plan accordingly.”
LLP Registration is on if you have DPIN
If you already have the DPIN/DIN for proposed partner, then you can still register your LLP in India. This is because all the other LLP forms are already present except DIN form. Hence, if you already have the DIN number, then you don’t need to file it again. You can directly apply for LLP registration.

Conclusion
LLP registration is one of the most famous type of entity after company registration and hence suspending the LLP registration just because of up gradation is improper. The government should have developed the new system first and hence, replace it with the existing system, so that no time gap would have arised.
Anyways, let us hope the new forms must be able to solve the purpose and simplify the LLP registration in the years to come. For any information, please email us at info@hubco.in.
